Senator Harry Brown Constituent Update April 12, 2007"This week at the General Assembly we had a shortened week due to Easter this past Sunday. We did hear some bills in committees, but we voted on only a few in the Senate.
On Wednesday, the Senate passed Senate Bills 125 and 361. SB 125 would make alcohol inhalers illegal. Alcohol inhalers are a relatively new device that allows alcohol to be inhaled, rather than drunk. These devices pose a potentially dangerous risk of alcohol poisoning to users. SB 381, which I cosponsored, would allow the wildlife resources commission to temporarily and conditionally lift the ban on no-wake zones, if a local government requests to under special circumstances. The wildlife resources commission can only do so as long as public safety and welfare are not compromised.
The Onslow County Farmers Market opens next weekend on April 22 and will remain open through November 21 on Tuesdays and Saturdays from 9am to 3pm. The farmers market is the best place to find fresh blackberries, blueberries, strawberries, vegetables, honey, bedding plants, and cut flowers. The farmers market is a great way to not only get the best produce available, but also to support local farmers and the economy. With the recent cold spell and severe weather that has damaged crops, we need to do everything we can to ensure our farmers will be around for future generations to enjoy their products.

EDITOR'S COMMENTS: BELIEVE IT OR NOT FOLKS!
There's a new property listing, just off Wheeler Creek Road, on Holly Drive, in Eastwood Subdivision. The "For Sale" sign went up over the weekend. It's just under one-half acre, a wooded parcel with absolutley no improvements. Nothing but trees. It has no waterfront, nor does it have a view of the water. It sold for around $5,000.00 a few years back. The asking price is $120,000.00.

A fund raiser for the Sneads Ferry Citizens In Action (SFCIA) will be held on Saturday, April 21st, from 11:00 a.m. until 3:00 p.m., at Four Corners/Monks Corners. Hot dogs and beverages will be served. Donations will be accepted to help with the work the SFCIA is doing in the community.

"HEALING THE WATERS" CEREMONY
On April 21, 2007, at 7:00 p.m., at Greenfield Lake, in Wilmington, N.C., the "Hands Around the Lake" project, will be holding a fifteen-minute candlelight vigil, with chanting, affirming and blessing all the waters of the world. This is a part of the work the "Hands Around the Lake" project is doing in raising consciousness and "healing the waters of the world," using Greenfield Lake as a global symbol.
On this same day, there will be an all-day festival to celebrate Earth Day, at Hugh Mac Rae Park, Oleander Drive, Wilmington. The "Hands Around the Lake" project, will have a table set up, at the festival, to pass out information and recruit volunteers for their candlelight vigil that night. RECOVERY GROUP
For those seeking recovery from alcohol, drugs, codependence, etc., and their families, this is the group. The group meets every Tuesday night, at 7:00 p.m., at New River Community Church, Wheeler Creek Road, Sneads Ferry. This group provides an anonymous, nurturing, loving and supportive environment for healing and recovery. All you need to do is just "show up."POSTED FRIDAY, MARCH 30, (11:00 P.M.)
"TURNING AWARENESS INTO ACTION" The Sneads Ferry Citizens in Action (SFCIA) were "walking their talk," tonight, at their meeting, which was held at the Sneads Ferry Community Center at 7:00 p.m. Even though the group was small, enthusiasm was not dampened. Glenn Queen, reiterated the importance of continuing the war on drugs and saving the children. He said, " the same thing that happens to celebrities, happens to our children." Queen cited examples such as Anna Nicole Smith and several other celebrities whose demise came through drug abuse. Queen said, "drugs are a worse problem than terrorism or anything."Lynn Hinnant followed Queen by updating the group on the progress the SFCIA has made in getting two of the Sneads Ferry adult businesses closed. He cited the Paradise Landing Bar and Southern Comfort; both which have been permanently closed, by court order. Cherries Bar/Club has decided not to appeal to superior court, but rather to adapt to the current zoning laws. Cherries has agreed for their female employees to wear appropriate attire which will not be in violation. Hinnant said, "they have agreed to wear a uniform like Hooters' uniform." He said this information was provided by the Onslow County attorney.
Onslow County Sheriff's Deputy, Coltrane, reminded the group that anonymous drug tips may still be made to P.O. Box 1115, Sneads Ferry, N.C. 28460. He said, "if you just take it to the counter and hand it to the clerk, you don't need to put a stamp on it. But, if you put in a mail box or even the box inside the post office, you must put a stamp on it." After Deputy Coltrane spoke, Pastor Dwayne Collins of North Topsail Shores, informed the group of the work he and others are doing in Sneads Ferry. Pastor Collins said, "every Tuesday night at the New River Community Church we are running a "Christ Centered" recovery group. We're using this book, "Celebrate Recovery," then he held up the book. Pastor Collins indicated that there are a couple of "Faith Based" treatment centers, such as The Potters Wheel, which can be used for those who need and want a residential treatment program. Pastor Collins and other members of the group are reaching out to those who need help with recovery from drugs, alcohol, codependence, etc., and their family members. The recovery group meets every Tuesday night, at 7:00 p.m., at the New River Community Church, on Wheeler Creek Road, in Sneads Ferry. The group provides an anonymous, nurturing and loving environment for healing and recovery.
There was group discussion on some possibilities for programs to inspire, motivate, educate and entertain young people in the community and keep them focused on positive goals for their lives. Queen said his skating rink could be used and Hinnant said he was open to using his arcade and other facilities for various activities. Everyone agreed that the community needs to come together and get involved, including teachers, parents, pastors and anyone interested in steering the young people toward successful and prosperous lives.
Lynn Hinnant concluded the meeting by stating that there would be an Easter Sunrise Service at Fulcher's Landing Campground, by the river, at 6:45 a.m. He also indicated there were going to be other events held there, in the future. The Hot-Topics Site will publish information as it is available.

SENATOR BROWN SEEKING PUBLIC INPUT

"This week at the General Assembly there were only a few votes on the Senate floor. In committee, I have been hearing and debating more bills that will be sent to the Senate for a vote in the coming weeks. Please let me know if there is a bill you have any concerns with.
I have received very positive feedback on my career and technical education bill. I am in the process of organizing a press conference in the coming weeks in order to bring more attention to the need for these schools. I am working on getting school representatives from Onslow and Jones Counties to come to Raleigh to voice their support for this legislation.
Several months ago at a forum in Sneads Ferry, I stated that I would be willing to introduce legislation to allow the people of Sneads Ferry to vote on whether they want to incorporate their village. Representative Grady and I are both introducing bills that would allow this choice through a referendum.
I have received word that Cow Channel will undergo an emergency dredging beginning this weekend. Bear Island at Hammocks Beach will be closed to visitors and ferry service will stop until May 25. The mainland portion of the park will still be open to visitors during the dredging. Cow Channel will also undergo a more extensive dredging during the 2007-2008 winter. The Division of Parks and Recreation is working with NCDOT to have Cow Channel added to the list of waterways that receive routine dredging.
I am always speaking with constituents throughout the week and on the weekends when I make visits to various places in the district. I always enjoy hearing what constituent’s opinions are on potential upcoming legislation and other hot-topic issues. As such, I would appreciate any thoughts you may have on the following issues:
1. Do you feel the mandatory school attendance age should be raised from 16 to 18?
2. Should local school districts have the authority over their own school calendar?
3. Should ethics hearings and complaints be open to the public?
4. Would you be in favor of tolls to help pay for roads?
5. Would you support a ban of smoking in all indoor public places?
6. Do you feel there should be a moratorium on the death penalty?"

POSTED FRIDAY, MARCH 23, 2007 (5:00 P.M.)INCORPORATION MEETING TODAY
A luncheon meeting was held at noon today, at the Riverview Cafe, to discuss the progress of the incorporation bill. North Carolina Representative, Robert Grady, met with members of the interim village council and some of the proponents of incorporation. Two of the interim council members were unable to attend, due to their work responsibilities. Grady presented the interim council with a draft copy of the incorporation bill and said it should be out the first part of the coming week, as being filed.
The names of the interim council mayor and mayor pro-tem have been added to the bill. The interim mayor is Scotty Everett and interim mayor pro-tem is Bob Bryant. A slight error has been corrected in the bill. There was an error in the spelling of Everett's Creek, as it related to the map of Sneads Ferry. Also, some minor changes will be made to the bill, as to when the official election of mayor and village council will take place, to comply with current statutes. The Hot-Topics Site does not know what those changes will be at this time. Also, it is uncertain when the House and Senate will vote on the incorporation bill or when the voters of Sneads Ferry will vote on the incorporation issue.

COUNTY COMMISSION MEETING TONIGHTThe Onslow County Commission meeting was held tonight at 7:00 P.M., in the Strickland Superior Court Room, in Jacksonville. There were several items on the agenda pertaining to Sneads Ferry, therefore there were a considerable number of Sneads Ferry residents present. The Hot-Topics-Site will only cover those items affecting Sneads Ferry. There were four requests for rezoning in Sneads Ferry. They are as follows:
(1) Duane Seward/MBDI Property Rezoning request from HB, R-20, and R-30M to R-10. Duane Seward, MBDI, petitioned to have five parcels totaling 110.9 acres, located along N.C. hwy. 172 rezoned from Highway Business (HB), Residential-20 (R-20), and Residential 30M (R-30M) to Residential 10 (R-10). At its March 1 meeting, the Planning Board voted unanimously to recommend denial of the proposed rezoning request but adopted a motion stating that it would not be opposed to rezoning to R-20, that part of the site not already so zoned. The developer withdrew his request from R-10 and changed it to R-20. The County Commissioners approved the zoning change to R-20, with HB property remaining at HB.
(2) Castle Ventures Rezoning request from R-8M to CB. Castle Ventures petitioned to have four parcels totaling 2.19 acres, located along Wheeler Creek Road rezoned from Residential 8M (R-8M) to Community Business (CB). At its March 1 meeting, the Planning Board voted unanimously to recommend approval of the proposed rezoning request. The planning board indicated that all hearing notices had been provided in accordance with the zoning ordinance. However, in this case, some complaining Sneads Ferry residents, who don't even live in the area, decided to step forward and oppose the zoning change. After listening to complainers, the Board allowed some advocates for the zoning change, who actually live in the Wheeler Creek area, to voice their opinions. The Board ultimately voted to approve the zoning change to CB (Community Business). The spokesperson for the developer, stated that the developer was considering dry boat stacks for the property and intended to allow public access.
(3) Brunswick Properties Rezoning request from RA to R-15. Brunswick Properties petitioned to rezone a 22.23 acre parcel located along N.C. hwy. 172 from Rural Agriculture (RA) to Residential 10 (R-10). The planning staff had previously recommended approval of the proposed rezoning request. The zoning request was approved by the commissioners.
(4) William Malcolm Rezoning request from R-20 to R-10. William Malcolm petitioned to have a 28.43 acre parcel located along Chadwick Acres Road rezoned from Residential (R-20) to Residential 10 (R-10). The planning staff had previously recommended approval of the proposed rezoning request. And, at it March 1 meeting, the Planning Board voted five to one to recommend approval of the proposed rezoning request. The Planning Board's recommendation was included in the agenda materials as well as an amendatory ordinance of approval and a resolution of denial for the Board to consider. To further complicate this matter, some disgruntled residents of Chadwick Acres, along with a couple of their supporters, who don't live in that area, showed up and expressd their disapproval of rezoning the property. The commissioners ended up denying this rezoning request.
The next significant issue on the agenda, affecting Sneads Ferry, was ITEM 7, Preserving Onslow County's Commercial and Traditional Fishing Activities. Matthew Stuart, Onslow County Planning and Development, briefed the Board on this item. He said the staff had researched the issue and developed different approaches to this issue, based on information obtained from residents of Sneads Ferry and Swansboro. Public meetings were held in February 2007, at Dixon High School and Sand Ridge Elementary School for this purpose. Stuart presented the citizen input during a slide-show presentation. Interested citizens are permitted to submit comments until March 31.
The planning staff will use public comments to guide proposed changes to the county's regulations for Planning Board review and recommendation, at a meeting which is tentatively scheduled for May 3, 2007. The Board of Commissioners public hearing, review and decision, is tentatively scheduled for May 21, 2007.
The last item covered here is a request by the Sneads Ferry Lion's Club - Pinfish Tournament, for $4,000.00 to expand advertising for the event. The board approved the request.

"This week at the General Assembly, the deadline to file bills passed, which means there will be a flurry of bills introduced and sent to committees over the next two weeks.
I introduced two more bills this week. The first, Senate Bill 412: Homestead Exclusion Modifications, provides property tax relief to low income homeowners. This bill has two parts: the property tax circuit breaker and a property tax deferral. The property tax circuit breaker allows homeowners, who meet certain criteria, such as income level, age, and residency status, to choose between the property tax circuit breaker or the existing property tax homestead exclusion. The bill also provides additional assistance with a property tax deferral. This deferral allows homeowners, who also meet certain criteria, such as low-income, age, disability, and residency status to delay property tax payments by essentially taking out a loan to cover their property tax payment, which would have to pay back over time.
The second bill I introduced, Senate Bill 816, increases drug trafficking penalties by 5 years. This bill helps to address the drug problem in our communities, by providing a harsher punishment, which will hopefully help to deter these crimes.
In the coming week, I will be introducing my Career and Technical Education Bill, I have had the pleasure to sit down with Dr. June Atkinson, Superintendent of North Carolina Public Schools, who is agreement with my efforts to strengthen and fully develop North Carolina’s Career and Technical Education programs and regional schools. I will also be introducing a bill that will exempt the sales tax on textbooks for college students. Currently, I am working with our legal staff to make sure that the bill will be compliant with Streamlined Sales Tax Agreement, which North Carolina became a member of in 2001.
In the two Natural and Economic Resources Committees that I sit on, we have received budget presentations from the North Carolina Department of Natural Resources, as well as a presentation on the analysis of renewable energy sources. Additionally, I also have been monitoring the Joint Transportation Committee to insure that Department of Transportation is being responsible with its tax-collected funds.
On Wednesday and Thursday, the Senate passed two important bills, which will now be sent to the House for consideration. The first, Senate Bill 34, increases the penalty for killing a police or assistance dog. The second, Senate Bill 4, allows elected sheriffs to have access to prescription profiles and store stock of controlled substances. Currently, this privilege is only granted to FBI and SBI agents, which often limits the capabilities of local officers to obtain needed information in a short amount of time in an effort to combat the drug problem.
Also this week, I was appointed to Emergency Preparedness and Disaster Management Committee.

"According to the North Carolina Coastal Federation, a grant has been secured to build a pier at Morris Landing to begin an oyster shell recycling program. This effort coincides with Senate Bill 1848, which I introduced last year, in order to appropriate funds to construct a pier in Holly Ridge. In the near future, I expect Morris Landing to be expanded to serve as a full scale Oyster Hatchery in eastern North Carolina. Morris Landing will serve as a key component for the North Carolina Hatchery Program, which will provide educational and research benefits, as well as positive economic & environmental impacts."

SOUTHERN COMFORT ADULT BAR PERMANENTLY SHUT DOWN!
A "CONSENT JUDGMENT AND FINAL ORDER OF ABATEMENT" was issued against Southern Comfort Adult Bar, on Monday, February 26, 2007, at 10:15 A.M., in Onslow County Superior Court, by Superior Court Judge John W. Smith. Southern Comfort will no longer be allowed to operate as an adult business. The bar has been closed since a civil action was commenced in this matter by the filing of a Verified Complaint on February 6, 2007, seeking abatement of a public nuisance pursuant to Chapter 19 of the North Carolina General Statutes. A temporary restraining order was served on the owners, Ann and Troy Lawler and operator Reynold Lewis.
The State of North Carolina is the prevailing party in this matter and is entitled to recover the reasonable costs and attorney's fees incurred in the investigation and prosecution of this action. Reynold Enterprises, Inc., the corporation under which Southern Comfort operated, is ordered to pay to the Plaintiff, Onslow County, a total of $15,881.50 as reimbursement for the attorneys fees incurred in the prosecution, as provided by N.C. General Statute. The payment has been set-up in five installments which extend until February 1, 2008. The costs of abatement are a lien on the personal property used in conducting said nuisance until such amounts are paid.
The adult business zoning violation appeal was pulled, by the owners, and was not heard at the Zoning Board of Adjustment Meeting tonight, in Jacksonville. According to Southern Comfort's attorney, Victor Morgan, Jr, criminal charges are still pending in this case. However, Morgan is not sure at this time, when the case will be on the court calendar.
In conclusion, the court order states: IT IS therefore ORDERED, ADJUDGED and DECREED that: The existing business on the Property known as Southern Comfort is ordered effectually and permanently closed.

PUBLIC COMMENT MEETING: PRESERVING ONSLOW COUNTY'S COMMERCIAL AND TRADITIONAL FISHING ACTIVITIES
Tonight, a public meeting was held at Dixon High School Cafeteria, to identify and discuss possible alternative approaches Onslow County can take to: (1) Preserve and enhance commercial fishing operations and working waterfronts (2) Preserve and enhance opportunities for continuation of traditional home-based or limited-scale fishing activities, consistent with minimizing adverse impacts on neighboring residents (3) Preserve and enhance water access for use for commercial and traditional fishing activities.
County officials provided a three-page handout with a number of proposals which are being considered. And, after a power-point presentation of these proposals, the meeting reconvened around three information stations which contained posters noting the identified alternatives and were manned by County Planning staff to answer questions and hear comments. The public was asked to suggest other approaches or variations of the ones identified, if they chose to do so. Comment forms were also made available if anyone wanted to make a written suggestion.
The three pages of proposals are too numerous to list here, so it is recommended by the HOT-TOPICS-SITE that anyone who has an interest in this issue, contact Onslow County Planning and Development at 455-3661, and request a copy of the proposals. This issue will most likely effect everyone, whether fisherman or property owner, at some time, so let your voices be heard now before all decisions are made.

***SOUTHERN COMFORT CASE OFF THE DOCKET!
The case against Southern Comfort Adult Club, which was scheduled to be heard in superior court tomorrow morning, will not be heard, according to the Superior Court Clerk's Office. The county would have been asking the court to issue an injunction permanently prohibiting the operation of the Southern Comfort Adult Club.
Details of why the case is not going to be heard tomorrow, have not yet been released. As they are made available, they will be published at this site.

CHERRY'S ON THE CHOPPING BLOCK AND SOUTHERN COMFORT NOT FEELING SO COMFORTABLE: ONSLOW COUNTY ZONING BOARD OF ADJUSTMENT MEETING TONIGHT!
Southern Comfort Bar and Cherry's were on the agenda at the Board of Adjustment meeting, tonight, in Jacksonville. Both adult businesses had appealed a county decision that they are in violation of current zoning laws. Southern Comfort was first on the agenda and right away its attorney,Victor Morgan, requested a two week postponement. After stating several reasons for the request, i.e. Southern Comfort is already closed down and the county is pursuing a civil nuisance abatement case against the club, with a hearing scheduled for Thursday, February 15th, in superior court. The county will be asking the court to issue an injunction permanently prohibiting the operation of the Southern Comfort Adult Club. Morgan stated that the issue would probably be resolved as a result. The board voted in favor of a postponement.
Now Cherry's is another story. It seemed like a sexual twilight-zone, as all of the stories were told. Sworn affidavits were submitted stating that the dancers in Cherries were nude, with the exception of a G-String, and that sex-acts had been witnessed in the back room. One man referred to the back room as the VIP room. Based on the oral testimony of one county official, who had a covert surveillance going on at Cherry's, he witnessed women dancing wearing only a G-String. He said he also perceived sexual acts taking place in the room behind the stage, that he could see the silhouette because the lighting was quite good in that area.
After about two and a half hours of legal wrangling by Jeffrey Miller, attorney for Cherry's, the county attorney, the board of adjustment and all the affidavits and public comments, the board finally voted on the issue before them. Miller's argument that Cherry's was not an adult business didn't hold any water with the board. The board voted 5 - 0, that Cherry's is in violation of the adult business zoning ordinance and that the board uphold the ruling of the zoning officer in its entirety. The board members concurred that Cherry's is operating as an adult business and that it is within 1000 feet of a residence and also it is located in a highway business zone rather than an industrial zone.
It will take about two to three weeks for the paper work to be prepared and submitted to the attorney for Cherry's. Then, they will have 30 days to appeal the Board of Adjustment's decision, through the courts.

COMMERCIAL FISHING ISSUES PUBLIC INPUT MEETING SCHEDULED
A public information meeting has been scheduled at Dixon High School Cafeteria, on February 20, 2007 at 6:30 p.m., to discuss and identify potential solutions to issues pertinent to commercial fishing operations and working waterfronts. Anyone interested in these issues, is invited to attend the meeting and let your opinion be known. These issues will be addressed by the Onslow County Commissioners later this year.

SOUTHERN COMFORT FACES SAME FATE AS PARADISE LANDING BAR!!
It was quite obvious that something was happening in Sneads Ferry on Tuesday afternoon, as a number of Sheriff's Department vehicles lined the parking lot at Southern Comfort Strip Club. The law enforcement officers were inside the business, most of the afternoon. A media release by the Onslow County Sheriff's Department, last night, disclosed the reason for the action. A temporary restraining order, issued by Superior Court Judge John Nobles, was served by the deputies, against the property owners and business operators of Southern Comfort.
Initially, only violations of the zoning laws were involved, however, after several arrests for indecent exposure and crimes against nature, during a midnight raid last month, now criminal summons have been served on the owners and operator of Southern Comfort and has culminated in another public nuisance abatement case, like the one that permanently closed the Paradise Landing Bar. Also, Southern Comfort was recently placed off-limits to military personnel by the Armed Forces Disciplinary Control Board.
An appeal on the zoning violations, filed by the club's owners, will be heard by the Onslow County Board of Adjustment on Tuesday, February 13, 2007, at 6:30 p.m., in Jacksonville at the Health Department complex. And, a preliminary injunction hearing for the Southern Comfort Bar, will be held in superior court on February 15, 2007, at 10:00 a.m.

***INCORPORATION UPDATE***
On Monday, December 5, 2006, the Joint Legislative Commission on Municipal Incorporations, accepted the incorporation petition submitted by the Sneads Ferry Interim Council. After a deeper investigation into the proposal, state officials will determine whether or not to approve it. If approved, then it will go to the North Carolina House and Senate for a vote, and then to the North Carolina Justice Department. According to legislators, Sneads Ferry will probably be looking at a referendum around November 2007, if all goes well.

***INCORPORATION UPDATE***
According to an email, received today, from N.C. Senator Harry Brown, a meeting will be held next week to review the petition for incorporation of Sneads Ferry. This is a part of the ground work required to have a referendum on the ballot to vote for or against incorporation.
